1. Who you are buying from
Ferutz is a brand of Chef Ceber Inc., a company incorporated in Ontario, Canada, with its registered address at 10651 Keele Street, Maple, Ontario, L6A 3Y9, Canada. Chef Ceber Inc. is the seller of record for every order placed on this site and is registered for GST/HST. Our GST/HST registration number appears on the invoice for your order.
2. Who may order
You must be the age of majority in your province or territory to place an order, and you must be using a payment method you are authorized to use. Orders may only be shipped to addresses in Canada.
3. When a contract is formed
Placing an order is an offer to buy. The order confirmation email we send is an acknowledgement that we received your order, not acceptance of it. A contract of sale is formed only when we ship the goods, and it covers only the goods actually shipped.
We may decline or cancel an order, in whole or in part, before shipping. Reasons include the product being out of stock, a pricing or description error, a payment we cannot verify, an address we cannot deliver to, or an order that appears to be for resale rather than personal consumption. If we cancel an order you have already paid for, we refund it in full to the original payment method.
4. Prices, taxes, and errors
All prices on this site are in Canadian dollars and exclude taxes and shipping unless stated otherwise. Applicable GST, HST, PST, or QST is calculated from your shipping address and is shown, itemised, before you pay. Shipping is calculated from your address and the weight of your order and is also shown before you pay.
Prices can change at any time, but the price that applies to your order is the price shown at checkout when you place it. If a product is listed at an obviously incorrect price because of a technical or human error, we are not obliged to sell at that price. We will contact you and either confirm the corrected price or cancel and refund the order in full, at your choice.
Bundle prices reflect a discount on the combined price of the bags in that bundle. The discount applies to the bundle as offered; adding the same bags to your bag individually is charged at the individual prices shown.
From time to time an individual product is offered at a promotional price. Where that happens the product page shows the promotional price alongside the regular price it replaces, and the promotional price is what you are charged. Promotions run for a limited time, can be withdrawn or changed at any time before you place your order, and cannot be applied to an order already placed. Where a promoted bag is part of a bundle or a box you build yourself, the promotional price is used to work out that bundle or box price, and the saving shown is the total saving against the regular prices.
5. Payment
Payment is taken in full when you place your order, through our payment provider. We do not store your full card number. By submitting an order you confirm that you are authorized to use the payment method and you authorize us to charge the total shown at checkout.
If a payment is declined or later reversed, we may cancel the order and any pending shipment.
6. Delivery, title, and risk
Delivery estimates shown at checkout are the carrier's estimates and are not guaranteed. Title to the goods and the risk of loss or damage pass to you on delivery to the address you gave us. If a parcel is lost or damaged in transit, our Shipping and Returns policy sets out how we put it right.
You are responsible for giving us an accurate, complete delivery address. We are not responsible for a delivery failure caused by an address error you made, though we will always try to help.
7. Cancellation, returns, and refunds
Our Shipping and Returns policy forms part of these terms and sets out when you may cancel an order, what we do about damaged, wrong, or missing items, and how refunds are issued. Because Ferutz products are food, we cannot accept returns of opened packages and we do not offer change-of-mind refunds on food that has shipped.
Nothing in these terms limits the rights you have under applicable consumer protection legislation in your province or territory.
8. Product information and allergens
We publish ingredients, allergen advisories, certifications, and a nutrition panel for every product, and we keep them current with the labels on the bags we ship. The label on the package you receive is the authoritative source. If you have a food allergy or intolerance, read the label before eating, and do not rely on the website alone.
Product photography is illustrative. Piece count and appearance vary naturally because the fruit inside is whole and real.
9. Our liability
To the extent permitted by law, our total liability arising out of or relating to an order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss. Nothing here excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by our negligence.
10. Governing law
These Terms of Sale are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Consumers keep the benefit of any mandatory protections of the province or territory where they live.
